Welcome to Chotu AI. By accessing or using our website and services, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

1. Service Description

Chotu AI provides a WhatsApp automation platform that integrates with Tally and other ERP systems to facilitate order taking, payments, and collections ("Service"). We act as a technology provider enabling you to communicate with your customers via the WhatsApp Business API.

2. WhatsApp Business Policy Compliance

You agree to comply with all WhatsApp Business Policies. Specifically:

  • Opt-In Consent: You acknowledge that you have obtained explicit consent from your end-customers before sending them outbound messages via Chotu AI.
  • Prohibited Content: You will not use the Service to send spam, offensive content, or messages related to illegal goods/services as defined by Meta's Commerce Policy.

Important: Chotu AI is not responsible if your WhatsApp Business number is banned by Meta due to policy violations (e.g., spamming or low quality rating). You are solely responsible for the messages you send.

3. Data & Tally Integration

You grant us a limited license to access your Tally data (via our local connector) solely for the purpose of providing the Service. You represent that you have the right to share this data. We do not edit or alter your Tally accounting records; we only read data or push approved vouchers.

4. Payment & Subscription

Services are billed on a monthly or annual subscription basis. WhatsApp conversation charges (UIC/BIC) are billed directly based on Meta's prevailing rates. Refunds are processed only in cases of service downtime exceeding 48 hours.

5. Limitation of Liability

To the maximum extent permitted by law, Chotu AI (Singla Consultancy Inc) shall not be liable for any indirect, incidental, or consequential damages, including loss of profits or data, arising from your use of the Service. Our total liability is limited to the amount you paid us in the past 12 months.

6. Termination

We reserve the right to suspend your account immediately if we detect: (a) Violation of WhatsApp Policies, (b) Non-payment of fees, or (c) Abuse of the platform.

7. Governing Law

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in [Your City], India.
